Consumer Law
The Consumer Law area of FCAR operates in a preventive, advisory, or litigious manner in conflicts involving the relationships between suppliers of goods, service providers, consumers, and consumer protection and regulatory agencies.
We handle cases of high complexity and relevance across various sectors, such as the automotive, pharmaceutical, food, tobacco, and health industries, particularly in cases involving product liability.
Main Services Provided:
- Advisory services in both pre-litigation phases and legal support for strategic decision-making within the company;
- Representation in administrative procedures (SENACON, PROCON, and Public Prosecutor’s Office);
- Engagement in strategic judicial processes, such as Public Civil Actions and significant individual cases, especially to prevent the establishment of negative case law, as well as arbitration procedures related to consumer law;
- Consultation on issues of liability, commercial practices, and contractual protection, through the preparation of legal opinions;
- Execution of Conduct Adjustment Terms (TAC) before consumer protection agencies at all levels of the Federation;
- Crisis management involving aspects of Consumer Law;
- Drafting and conduction of recall campaigns.
